THESE TERMS AND CONDITIONS FOR THE USE OF THIS SITE (THE “USER AGREEMENT”) GOVERN YOUR USE OF THIS WEBSITE (WWW.PURCHASINGPOWER.COM) AND ALL AFFILIATED PAGES (INDIVIDUALLY AND COLLECTIVELY, THE “SITE”) PROVIDED BY PURCHASING POWER, LLC (“PURCHASING POWER,” “WE,” “OUR” OR “US”). PLEASE READ THIS USER AGREEMENT VERY CAREFULLY.
BY ACCESSING, BROWSING, SHOPPING OR OTHERWISE USING THIS SITE, YOU AGREE TO BE BOUND BY THIS USER AGREEMENT. IF YOU DO NOT AGREE WITH THE TERMS OF THIS USER AGREEMENT YOU SHOULD IMMEDIATELY CEASE YOUR USE OF THE SITE.
THIS USER AGREEMENT CONTAINS AN ARBITRATION CLAUSE GOVERNED BY THE FEDERAL ARBITRATION ACT.
Important Information About This User Agreement and Your Use of the Site
As used in this User Agreement, the terms “you” and “your” refer to any individual, company, or legal entity, that accesses, views, collects information from or otherwise uses this Site. You agree to this User Agreement, and all of its terms and conditions, by accessing, browsing, shopping or otherwise using the Site. You consent to being recorded by Purchasing Power or third parties that may record on Purchasing Power’s behalf (e.g., chatbots, session replay software, etc.). This User Agreement is subject to change without prior notice at any time, in Purchasing Power's sole discretion. The revised User Agreement is effective upon posting on the Site. The most recent date on which the User Agreement was revised appears above. By accessing, browsing, shopping or otherwise using the Site after a change has been posted to the Site, you accept that change. Customers should frequently check this User Agreement and the Privacy Policy referenced below. In addition to adhering to the terms of this User Agreement, you also agree to comply with all applicable laws and regulations when accessing or using the Site.
Site Content
The User Agreement governs the products, services, information, materials, graphics, arrangement, coding, design, text, sound and other items and information contained on the Site (collectively, the “Content”). Site Content may be provided by Purchasing Power or its licensors. The Content may be changed by Purchasing Power at any time and without notice to you. Any Content that appears on the Site with an “as of” date is considered to be published on the Site as of that date. Purchasing Power reserves the right to terminate any Content or the Site in its entirety at any time, without prior notice.
Site Content is protected by law, including, but not limited to, United States copyright law and international treaties. This Site is controlled and operated by Purchasing Power from its offices within the United States. Purchasing Power makes no representation that the Content is appropriate or available for use in other locations, and access to them from territories where the Content is illegal is not authorized. Those who choose to access this Site from other locations do so upon their own initiative and are responsible for compliance with applicable local laws.
You agree not to attempt to log on to the Site from any country under sanctions by the Office of Foreign Asset Control. A list of countries under sanctions may be found on the United States Department of the Treasury website. Any attempt to log on to the Site from such a country may result in your access being restricted or terminated.
Use of the Site and Site Content
Except as stated herein, none of the Content may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, tableing or otherwise, without the prior written consent of Purchasing Power, its licensors or the copyright owner. Limited permission is granted to display, copy, distribute and download Content for personal, non-commercial use, but only so long as you do not modify the Content and that you retain all copyright and other proprietary notices contained in the Content.
The Site and the Services and Content of the Site are intended for use by individuals who are at least 13 years old. If you are under the age of the 13, you should not be visiting the Site. Purchasing Power does not knowingly collect any information from individuals who are under the age off the 13. We advise all visitors to the Site under the age of 13 not to disclose or provide any personally identifiable information. You are granted a limited, revocable and nonexclusive right to create a hyperlink to the home page of the Site so long as the link does not portray Purchasing Power or its products or services in a false, misleading, derogatory or otherwise offensive matter. You may not use any Purchasing Power logo or other proprietary graphic or trademark as part of the link without express written permission.
You are prohibited from using this Site and to post or transmit any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material or any material that could constitute or encourage unlawful conduct. Purchasing Power may from time to time monitor or review material transmitted or posted using this Site and reserves the right to delete any material Purchasing Power deems inappropriate in its sole discretion. Purchasing Power is, however, under no obligation to monitor or review such material and assumes no responsibility or liability arising from such material.
You may not take any action, or omit to take any reasonable action, which would constitute an invasion of privacy or other violation of proprietary rights of any other user of the Site in any applicable jurisdiction. Use or distribution of tools designed for compromising privacy or security is strictly prohibited.In addition to the prohibitions found elsewhere in this User Agreement, the following activity on the Site is also expressly prohibited:
any non-personal or commercial use of any robot, spider, other automatic device or manual process to monitor or copy portions of the Site or the content contained herein without prior written permission by Purchasing Power; collection or use of any product listings, descriptions or prices, from the Site for the benefit of another merchant that supplies products competitive with or comparable to those offered on the Site; andAny use of, visits to, or other action that imposes an unreasonable or disproportionately large load on the Site, or otherwise interferes with its proper and timely functioning.
Any prohibited use of the Site as discussed in this User Agreement terminates your right to use the Site.

Purchasing Power does not endorse any third-party websites not under the control or operation of Purchasing Power, has not reviewed any or all such websites that may be linked to this Site, and is not responsible for any such websites linked to this Site or any content thereof or services provided through such websites. You should be aware that third-party sites may have a privacy policy and terms governing the use of their site that differ from our Privacy Policy and this User Agreement. Your use of the links to any third-party websites on this Site is at your own risk. By linking to a third-party website or permitting a link from a third-party website to this Site, we do not endorse the site operator or the content of the linked third-party website.
Trademarks and Copyrights
Trademarks, logos and service marks displayed on this Site are registered and unregistered trademarks of Purchasing Power, its licensors or content providers, or other third parties. All of these trademarks, logos and service marks are the property of their respective owners. Nothing on this Site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the Site without the owner's prior written permission, except as otherwise described herein. Purchasing Power reserves all rights not expressly granted in and to the Site and the Content. This Site and the Content as compilation under the copyright laws of the United States and other countries.
Limitation of Liability
Your use of this Site and any information and Content from this Site is at your own risk.

Purchasing Power assumes no liability or responsibility for any damage to you, your computer or your property, due to your access to, use of or downloading of this Site or any Content provided on this Site or any services offered by or through the Site.
Arbitration
All claims arising from the purchase of goods and services are subject to binding arbitration pursuant to the terms set forth in the Additional Terms and Conditions of the Retail Installment Sales Contract (the "Customer Contract") and by making a purchase from this Site, you expressly waive a trial by jury and accept arbitration of any disputes pursuant to the terms and provisions as more fully set forth in the Customer Contract. You are urged to review that document to familiarize yourself with the terms set forth therein.
OTHERWISE ANY CLAIM OR DISPUTE THAT YOU MAY HAVE AGAINST Purchasing Power, its service providers, agents, employees, successors, assigns, affiliates, parents, subsidiaries and any content provider or offeror of goods or services on this Site, WHETHER RELATED TO YOUR USE OF THE SITE IN ANY MANNER OR IN BASED ON ANY OF THE CONTENT FOUND ON THE SITE, INCLUDING (BUT NOT LIMITED TO) THE ENFORCEABILITY OF THIS ARBITRATION AGREEMENT, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION under the Code of Procedure (the "Code") of The American Arbitration Association (1-800-778-7879); www.adr.org in effect at the time the claim is filed. Notwithstanding any choice of law provision included in this User Agreement, this arbitration agreement is subject to the Federal Arbitration Act (9 U.S.C. §§ 1-16) and the New York Convention on the Enforcement of Arbitration Awards (9 U.S.C. §§ 201-208 or as codified in the jurisdiction where enforcement of the award is sought). Hearings shall be held as provided by the Code and if any In-person Hearing is required, it shall be held in Atlanta, Georgia. Each party shall bear its own cost of any legal representation, discovery or research required to complete arbitration.
Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Purchasing Power, its officers, directors, employees, agents, licensors, suppliers and all those working in connection with them, from and against any and all losses, damages, expenses and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or any activity related to your Internet account (including, but not limited to, negligent or wrongful conduct), by you or any other person accessing the Site using your Internet account.
Privacy
Please review our Privacy Policy located at www.purchasingpower.com/privacy-policy which also governs your visit to this Site.
Account and Password
In order to access certain features at the Site, you may be required to register for a Site account ("Account"). However, most features can be accessed without an Account. If you opt to register for an Account, you agree to: (a) provide true, accurate and complete information about yourself as prompted by the registration form; and (b) maintain and promptly update such information to keep it true, accurate, current and complete as permitted through the functionality of the Site. If Purchasing Power has reasonable grounds to suspect that the information you provided on the registration form or otherwise is untrue, inaccurate or incomplete, we may suspend or terminate your Account and refuse any and all current or future use of the Site (or any portion thereof). You are responsible for all use of your Account under any screen name or password by any person or entity and for ensuring that your Account complies fully with the provisions of this User Agreement. You acknowledge and agree that Purchasing Power will have no liability associated with or arising from your failure to maintain accurate information about yourself, including, but not limited to your failure to receive important information and updates about the Site.
You are responsible for maintaining the confidentiality of your Account and password and you agree to accept responsibility for all activities that occur under your Account or password. Purchasing Power reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders in its sole discretion.
Communications with Purchasing Power
Purchasing Power shall strive to preserve the confidentiality of all information transmitted to this Site in connection with the purchase of goods and services offered on or through the Site. Any other communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by Purchasing Power for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, Purchasing Power is free to use any ideas, concepts, know-how or techniques contained in any communication you send to Purchasing Power or the Site for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products using such information.
Customer Communication
You consent to Purchasing Power communicating with you in connection with your Purchasing Power account via e-mail, text message, calls, direct drop voicemail, and push notifications using any telephone number, e-mail address, or other contact information that you provide, or will provide in the future, to Purchasing Power. Purchasing Power may use these means of communication even if you will incur costs to receive telephone messages, telephone calls, SMS or text messages, e-mails, or other methods of communications.
Communications may include, but are limited to, operations communication concerning your account (e.g., shipping notifications) and account recovery messages. All charges are billed by and payable to your mobile service provider. Purchasing Power will not be liable for any costs or delays in the receipt of any communication method. Delivery is subject to effective transmission from your network operator. Data obtained from you in connection with text messaging services communicating with us may include your mobile phone number, your carrier’s name and the date, time and content of your messages and other information you provide to Purchasing Power as part of the service. User Consent to receive text messages is not required in order to purchase goods from Purchasing Power or to participate in the purchase program.
Termination
Your access may be terminated at any time and for any reason or for no reason by Purchasing Power. You shall have no recourse and we shall have no liability with respect to any such termination. All provisions of this User Agreement relating to warranties, confidentiality obligations, proprietary rights, User Submissions, limitation of liability and indemnification obligations shall survive the termination or expiration of your access or use of the Site or any services offered on or through the Site. Upon termination, you must destroy all Content obtained from the Site.
Severability
In the event that any of the provisions of this User Agreement is held to be unenforceable, the remaining terms and provisions shall be unimpaired, and the unenforceable term or provision shall be modified or replaced with an enforceable term or provision that comes as close to the intention of the term or provision deemed unenforceable.
Applicable Law and Choice of Venue
Any claim or dispute relating to the use of this Site, the Content and/or under this User Agreement is governed by the laws of the State of Georgia without regard to conflict of law rules. You consent to jurisdiction of the federal and state courts located in Fulton County, Georgia, to hear any such claims.
Changes, Misprints, Errors and Cancellations
Subject to applicable law, we: (a) reserve the right to change the goods and services advertised or offered for sale through the Site, the prices or specifications of such goods and services, and any promotional offers and any other Site Content at any time and from time to time without any notice or liability to you or any other person; (b) cannot guarantee that goods or services advertised or offered for sale on the Site will be available when ordered or thereafter; (c) reserve the right to limit quantities sold or made available for sale; (d) do not warrant that the Site Content (including without limitation product descriptions or photographs) are accurate, complete, reliable, current or error-free; and (e) reserve the right to cancel, to terminate or not to process orders (including accepted orders) where the price or other material information on the Site is inaccurate or when we recognize abuse of our policies. If we do not process an order for such reason, we will advise you that the order has been cancelled and will either not charge you or will apply credit to your Account.
Travel Vacations Terms & Conditions

Return Policy
No Cancellations, No Revisions and No Refunds
Once your travel or vacation package is reserved and confirmed, your travel purchase cannot be cancelled, returned or refunded in any way as ALL travel purchases are FINAL. There are no returns, cancellations or refunds allowed on any travel, vacation or attraction purchases. Once purchased, your travel package may not be changed in any way - no changes to names, times, dates or destinations are allowed.
All Travel Packages, Cruises, Theme Parks and Pricing
All prices are valid for travel as specified, are valid for new bookings only and are available to Purchasing Power customers residing in the United States (excluding Hawaii). All travelers must be booked on the same itinerary to be included in the package. Individual travelers cannot be added or deleted from a package after booking. Prices for land components, cruise components and vacation packages are subject to change until reservations are confirmed. Airfare prices and flight availability are subject to change without notice until booked. Seasonal and fuel or energy surcharges, restrictions, foreign currency fluctuations and blackout dates may apply. The exact price depends upon the day of departure, departure city, length of stay, ship, hotel, room or stateroom type, or other inclusions including, but not limited to, airfare, transfers, rental cars, taxes or administrative fees. For all bookings, any government-imposed increases in fees or taxes are the passenger’s responsibility to pay. Any increases in fees or surcharges that are imposed by our travel suppliers and are outside the control of Purchasing Power are the customer’s responsibility to pay. Unless otherwise noted, offers are not combinable with select rate codes, coupons or other offers. Vacation package hotel stays are not eligible for hotel loyalty programs, points or benefits. Any unused portion(s) of inclusions are nontransferable, nonrefundable and not redeemable for cash. Purchasing Power disclaims liability for any inaccuracies or typographical errors.
Unless otherwise indicated, prices do not include airfare, ground transportation, gratuities, gasoline, underage/additional driver charges, upgrades, car rental drop charges, infant child seats, meals, telephone calls, some resort service fees, any personal or incidental items, or any other features not listed except where otherwise noted. Additionally, cruise prices do not include transfers, administrative fees, taxes, port expenses (TF&PE), and on-board charges like alcohol, shopping, etc.
Each product or service in a package is provided by the applicable Travel Supplier. We are not responsible for the performance of the Travel Supplier or for reimbursement of money paid by you (or any incidental or consequential or other damages) in the event that the Travel Supplier fails to perform its obligations. The Travel Supplier is directly responsible for any remedy or compensation.
Please read the detailed description of the cruise ship for other policies applicable to your cruise. Ship photos are representative only and do not necessarily depict the actual cabin in which guests will be accommodated. Prepaid gratuities are included for cruises.
Hotel (Room-Only) Reservations & Prices
Unless otherwise indicated in the hotel details and descriptions, all hotel room rates are based on a maximum of double occupancy. Charges for additional guests may apply and must be paid directly to the hotel at check-in. All prices are valid for travel as specified, are valid for new bookings only and are available to Purchasing Power customers residing in the United States (excluding Hawaii). Please read the Hotel Advisory, if applicable, for important information and additional terms and conditions that may affect your price and/or reservation. The balance owed on the reservation (if not prepaid) must be paid directly to the hotel at the time of checkout. Credit card authorization will be required upon check-in for room charges, taxes, deposit, applicable fees and incidentals. You are responsible for any incidental charges at your hotel, including, but not limited to charges for telephone access, in-room movies, energy surcharges, room service, mini-bar, and any applicable increases in taxes. The hotel is the merchant of record, and will be reflected on your credit card bank statement. Changes, cancellations, and no-shows may result in fees or changes to the price and inclusions. Additional surcharges (noted in the Hotel Advisory), restrictions, foreign currency fluctuations and blackout dates may apply. For all reservations, any government-imposed increases in fees or taxes are the guest’s responsibility to pay, even if the booking is paid in full. Any increases in fees or surcharges that are imposed by the hotel are outside the control of Purchasing Power and are the guest’s responsibility to pay. Unless otherwise noted, offers are not combinable with select rate codes, coupons or other offers. Any unused portion(s) of inclusions are nontransferable, nonrefundable and not redeemable for cash.You must be at least 18 or 21 years old to check-in to a hotel, depending on the specific property’s requirements. Please read the detailed description of the hotel for other hotel policies applicable to your stay. Hotel photos are representative only and do not necessarily depict the actual room in which guests will be accommodated.
Unless otherwise stated, prices do not include airfare, gratuities, transportation, gasoline, optional insurance, upgrades, meals, telephone calls, some resort service fees, any personal or incidental items, or any other features not listed. Purchasing Power disclaims liability for any inaccuracies or typographical errors.
Documents
For hotel and vacation rental (accommodations only) reservations, rental car reservations, land-only packages or air-inclusive packages, each of the services you purchased and/or reserved will be outlined on your confirmation emails. Therefore, the email is the only document you'll need to carry with you as you travel.
Cruise documents are offered electronically 30-75 days prior to departure, depending on your trip date and cruise line. Please check your documents to confirm accuracy of all information.
Airline Information
Baggage allowances and fees vary by airline; please check directly with the airline for baggage fees and policies. If baggage fees do apply, this cost will be additional and must be paid directly to the airline; these charges cannot be payroll deducted or paid for by Purchasing Power.
By purchasing an airline ticket, the passenger agrees to the terms and conditions of the airlines' contract of carriage, which can be viewed on the airline's website. In all cases, airlines may change flight schedules, aircraft, seat assignments, and alter or omit stopping points en route. Such changes or omissions are at the sole discretion of the airline and are outside the control of Purchasing Power. It is highly recommended that you reconfirm your flight information and check-in for your flights at the airline's website 24 hours prior to your scheduled departure. Failure to use any portion of your airline reservation may result in automatic cancellation for all continuing and return flights. Airline tickets are non-transferable, and name changes are not allowed. Other changes to the airline ticket after travel has commenced may not be allowed. Some airline tickets may not qualify for frequent flyer miles.
In all cases, unless additional time is required by the airline, it is important to arrive at the airport at least 90 minutes prior to departure for domestic flights and three hours prior to departure for international flights. Latecomers may lose their assigned seat or be denied boarding at their own expense. Choice of complimentary pre-reserved seat assignments may be limited at the time flight reservations are confirmed, and may not be assignable until check-in. For a fee, airlines may offer additional pre-reserved seat assignments, which may be purchased directly on the airline's website. Seat assignments are at the sole discretion of the airline and are subject to change by the airline without notice. Purchasing Power cannot provide or guarantee seat assignments.
When making an airline reservation, the Transportation Security Administration (TSA) requires the collection of your date of birth, gender and full name as it appears on the government-issued photo identification you'll use when traveling. Failure to provide this information will prohibit a ticket from being issued and may result in the cancellation of airline reservations.
Proof of Identity
For U.S. citizens, government-issued photo ID is required for all travel, both domestic and international. Passports are required for international travel. You will not be permitted to depart without necessary documentation. There may be additional requirements for international travel, such as inoculations or visas, and some countries require that passports be valid for six months or longer beyond your stay in the country. Passport and entry requirements are subject to change at any time without notice and you should check for up-to-date information before booking and departure. For the most current information on passport and entry requirements, please visit the official website for the U.S. Department of State (www.travel.state.gov). Special travel documents are required for children traveling with or without their parents. If you are traveling with children, please check with the airline or cruise line prior to departure. If you are not a U.S. citizen, you must contact the consulate of the country you are visiting (including Canada, www.cic.gc.ca/english/visit/visas.asp) to inquire about visa requirements. You must also contact the Immigration and Naturalization Service (1-800-375-5283, www.uscis.gov) for re-entry requirements into the United States.
Timeshare Advisory
When you arrive in your destination, even before you leave the customs area, you may be approached by many aggressive timeshare sales agents. Timeshare sales agents are very persistent and may entice you with offers of complimentary breakfasts, free transfers, discounted tours, etc., in exchange for your attendance at a presentation designed to sell their property. Timeshare selling can and does take place in many locations, including the airport, hotel lobbies, and even on the beaches and streets. These sales agents are in no way associated with your ground transportation operator or with Purchasing Power. Please refer to your travel itinerary for information on how to identify your transfer company representative and where to meet them upon arrival at your destination. This will ensure that your transfer arrangements are handled professionally by the company contracted by Purchasing Power. Most hotels have a timeshare division and these sales people also use aggressive tactics. Purchasing Power strongly advises you to refrain from accepting free or discounted offers from sales agents as such offers require your attendance at an intense timeshare sales presentation. Requests
Specific requests are subject to availability at the time of check-in. Seat assignments and bedding requests cannot be guaranteed. Some hotels and cruise lines impose an additional charge if a crib, a roll-away or a refrigerator is required, payable by the guest directly to the hotel or cruise line.
Rental Cars
All car rentals are subject to the rules and regulations of the car rental company. Late returns and returns to alternate locations are subject to charges or penalties paid by the renter directly to the car rental company. Cars are available for rental to individuals 25 years or older (exceptions apply) holding a valid driver's license. A surcharge may be added for drivers less than 25 years of age. Rates exclude gas, optional insurance coverage, and some applicable taxes and surcharges. Any additional fees will be collected at the time of rental. The car rental company requires the imprint of a valid credit card in the renter’s name as security to cover incidentals. Auto insurance is the responsibility of the registered driver. Additional drivers must be 25 years of age and will be charged an additional rental fee.

Plans are available to residents of the U.S. but may not be available in all jurisdictions. This plan provides insurance coverage for your trip that applies only during the covered trip.
